Le Ceramicotte
1. General Conditions
The following general terms and conditions of sale and use apply within Italy and the European Union to all sales made by Le Ceramicotte through its website domain www.leceramicotte.com. Users are kindly requested to carefully read these conditions before placing an order. By confirming that they have read and accepted these conditions while placing an order through www.leceramicotte.com, users agree to them unconditionally.
The use of the services is permitted exclusively to end users who have read the privacy policy regarding the processing of personal data and accepted these general conditions.
Pursuant to Articles 7 and 12 of Italian Legislative Decree no. 70 of April 9, 2003, the website www.leceramicotte.com is managed by Le Ceramicotte di Giada Stefani.
The seller offers products for sale on www.leceramicotte.com and conducts its e-commerce activity exclusively toward end users who qualify as consumers.
Consumers are natural persons accessing the Le Ceramicotte website for purposes unrelated to any commercial, entrepreneurial or professional activity they may carry out.
Definitions
Contract: means the agreement between the parties for the sale and purchase of products on www.leceramicotte.com, including the order, order confirmation and these contractual conditions.
Conditions: means these terms and conditions of sale.
Products: means the products available for sale on www.leceramicotte.com.
Order: means an order for products placed in accordance with these contractual terms and conditions of sale.
Order Shipping Confirmation: means the confirmation of the order containing details of the products purchased on www.leceramicotte.com. It is sent when the products are shipped.
Seller: means Le Ceramicotte di Giada Stefani.
User: means the consumer or customer purchasing products on www.leceramicotte.com.
These general conditions are an integral and essential part of the contract. All sales contracts concluded through access to www.leceramicotte.com by the user shall be governed by these terms and conditions of sale.
2. Pre-contractual Information
In compliance with Italian Legislative Decree no. 70 of April 9, 2003 concerning electronic commerce, Le Ceramicotte informs users as follows.
To conclude the purchase contract for one or more products on the website, users must complete an electronic order form and submit it to Le Ceramicotte following the instructions provided on the website.
The order form contains a summary of the essential characteristics of the ordered products, the relevant price including VAT, accepted payment methods, delivery methods and shipping costs.
The contract shall be concluded when Le Ceramicotte confirms the order submitted by the customer, after verifying the accuracy of the provided data and payment.
Before submitting the order form, users may correct any data entry errors by following the instructions on the website. Users are also required to request an invoice, if needed, before confirming the order.
Once the order form has been registered, Le Ceramicotte will send the user a confirmation email containing information regarding the purchased products, price, payment method and shipping details.
The order form will be stored in the Le Ceramicotte database for the time necessary to process the order and in compliance with applicable laws.
The seller may refuse orders that are incomplete, incorrect, lacking sufficient solvency guarantees or in case of product unavailability. In such cases, users will be informed via email or phone.
If ordered products become unavailable after the order has been submitted, Le Ceramicotte will promptly inform the user and refund any amount already paid.
3. Product Availability
Products offered on www.leceramicotte.com are available in limited quantities. It may happen that an ordered product becomes unavailable after the order registration. In this case, the user will be promptly informed via email or phone and the order will be cancelled.
4. Legal Guarantee
Title III of the Italian Consumer Code concerning “Legal guarantee of conformity and commercial guarantees for consumer goods,” particularly Articles 128 to 135-septies of Legislative Decree no. 206 of 2005, shall apply.
The legal guarantee protects users in the event of defects of conformity in purchased products and lasts 24 months from delivery of the goods.
In the event of a defect of conformity, users are entitled, free of charge, to restoration of conformity through repair or replacement where possible, or to an appropriate price reduction or contract termination in cases provided by law.
5. Sales Prices and Purchase Methods
Prices indicated on www.leceramicotte.com are expressed in Euro and include VAT. Unless otherwise specified, prices do not include shipping costs or additional charges.
Le Ceramicotte reserves the right to modify product prices at any time without prior notice. Changes shall not affect orders already confirmed.
6. Product Delivery
Ordered products will be shipped to the address provided by the user in the order form.
Deliveries are made Monday through Friday, excluding national holidays.
Order preparation may require up to 5 business days. Subsequent delivery times depend on the selected courier service.
Delivery is considered completed when the product is made available to the user at the indicated address.
Users are required to provide a valid phone number to ensure proper shipment handling.
It is the user’s responsibility to verify the condition of the delivered products. In case of damaged or tampered packaging, users must promptly report it by writing to sales@leceramicotte.com and accept the parcel “with reservation”.
Le Ceramicotte is not responsible for tampering occurring during transport by third parties pursuant to Article 1510, paragraph 2 of the Italian Civil Code.
Pursuant to Article 63 of Legislative Decree no. 206 of 2005, if the courier is selected directly by the user, the risk transfers to the user upon delivery of the goods to the carrier.
7. Withdrawal
Users who purchase products through www.leceramicotte.com have the right to withdraw from the contract within 14 days from receipt of the goods pursuant to Legislative Decree no. 206 of 2005.
Users wishing to make a return or exchange may send an email to sales@leceramicotte.com.
Le Ceramicotte is not responsible for shipping costs related to returns or exchanges unless the product has a recognized defect.
Users must ensure that their name, order number and contact details are included in the parcel.
Le Ceramicotte will issue refunds through the payment method used for the purchase unless otherwise agreed with the user.
The right of withdrawal is reserved for consumers pursuant to the Italian Consumer Code.
Products, even if opened, must be intact, unused and complete with original packaging, accessories and any fiscal documentation.
All returned items will be inspected. In case products do not meet these requirements, Le Ceramicotte reserves the right to refuse the return or apply a reduction to the refund amount.
Withdrawal requests must be communicated within 14 days of receipt of the goods by email to sales@leceramicotte.com.
Le Ceramicotte will subsequently communicate the return instructions.
Return shipping costs are borne by the user.
Refunds will be issued within 14 days from receipt of the returned goods or proof of shipment.
The right of withdrawal does not apply to personalized or custom-made products pursuant to Article 59 of the Italian Consumer Code.
8. Payment Methods
Payments for products purchased on www.leceramicotte.com may be made by credit card, debit card, PayPal or bank transfer.
Transactions are processed through PayPal and secure payment circuits.
Products will only be shipped after payment confirmation.
In case of payment by bank transfer, users must complete payment within 1 business day from order confirmation.
After 3 days without payment confirmation, Le Ceramicotte may cancel the order.
Gift Cards
E-Gift Cards are sent via email immediately after purchase and may only be used on www.leceramicotte.com.
E-Gift Cards are valid for 12 months from the purchase date and cannot be converted into cash.
9. Product Guarantees and Non-Conformity
Products sold on www.leceramicotte.com are made directly by the seller.
Product images and colors may slightly differ from reality due to screen settings.
Essential product characteristics are described within each product page.
As handcrafted products made by hand, small variations in shape, color, finish or size are to be considered distinctive characteristics and not defects.
In the event of a defect of conformity, users are entitled to repair or replacement of the product free of charge where possible.
10. Obligations and Responsibilities of Le Ceramicotte
These general conditions are governed by Italian law.
Le Ceramicotte undertakes to correct any errors in product descriptions as quickly as possible.
Le Ceramicotte shall not be liable for damages resulting from improper use of products or force majeure events.
Mandatory consumer protection rights provided by law remain unaffected.
11. Service Suspension
Le Ceramicotte reserves the right to temporarily suspend the service for technical interventions or security reasons.
12. Amendments to the General Conditions
These conditions may be modified at any time. Changes shall become effective from the date of publication on the website.
13. Processing of Personal Data
By placing an order, users accept that Le Ceramicotte may process the data necessary to fulfill the order in accordance with the Privacy Policy.
14. Applicable Law
These conditions are governed by Italian law.
Any dispute shall fall under the jurisdiction of the court of the consumer’s place of residence or domicile, if located in Italy.
15. Intellectual Property
The “Le Ceramicotte” trademark, logos, images, illustrations and all content on the website are the exclusive property of Le Ceramicotte di Giada Stefani.
Any reproduction, even partial, without prior written authorization is prohibited.
